Terms of use for diners
Last updated: · Version 1.0
In short
- The restaurant is the one selling to you; Cooku is the technology it uses.
- If you have allergies, confirm directly with the restaurant.
- Refunds and cancellations are handled by the restaurant.
- Your rights as a consumer remain intact.
1. What Cooku is
Cooku, operated by Cooku, a trade name operated by Victor Leonardo Garza Martínez, an individual acting as a sole proprietor, with an address for notices at Ciudad de México, C.P. 03400, México, is the technology that restaurants and hospitality businesses use to display their menu, receive orders and reservations, sell tickets and take payments. These terms apply when you use those pages as a customer (a "diner").
The restaurant, not Cooku, is the one selling to you. The restaurant decides its menu, prices, availability, times and policies, and is responsible for the products and services it provides to you.
2. Orders and prices
- Prices, taxes, service or delivery charges and availability are set by the restaurant and shown before you confirm.
- Your order is confirmed when the restaurant accepts it. The restaurant may reject or modify it, for example if an item is sold out, and must inform you.
- Review your order before confirming it. If something is not right, contact the restaurant.
3. Allergies and dish information
Ingredient and allergen information is published by the restaurant. If you have an allergy or dietary restriction, state it and confirm it directly with the restaurant staff before eating.
Cooku does not prepare, handle or deliver food, and cannot guarantee the accuracy of the information each restaurant publishes.
4. Payments and refunds
Online payments are processed by specialized providers (for example, Stripe, Powertranz, Tilopay, PagueloFácil or Yappy) on behalf of the restaurant. Cooku does not store your full card number. Cancellations, returns and refunds are decided and handled by the restaurant in accordance with its policies and the law.
5. Reservations, events and tickets
Reservations, guest lists and event tickets are governed by the conditions of the restaurant or organizer (grace period, cancellation, capacity, minimum age, dress code). Present your code or confirmation on arrival. The organizer is responsible for holding the event and, where applicable, for refunds.
6. Home delivery
Deliveries are made by the restaurant or the courier it chooses. Provide a correct address and phone number; delivery times are estimates.
7. Your contact details
If you choose, your name and contact details are saved on your device so you don't have to type them again; you can clear them with the "Not me" option. The restaurant is the controller of your data and Cooku processes it on its behalf, as explained in the Cooku Privacy Policy (https://usecooku.com/pa-en/politica-de-privacidad) and in the restaurant's privacy notice.
8. Messages you may receive
You will receive email or WhatsApp messages related to your order, reservation, ticket or invoice. WhatsApp updates about your order only reach you if you accepted them when ordering; to stop them from the Cooku number, reply STOP. You will only receive promotions from the restaurant if you agreed to them, and you can unsubscribe at any time with the link in each email or by asking the restaurant.
9. Acceptable use
Do not place fake orders or reservations, do not use another person's payment or contact details without authorization and do not attempt to interfere with the operation of the pages. The restaurant may reject orders or reservations in those cases.
10. Liability and your rights as a consumer
Cooku is responsible for the operation of its technology, not for the restaurants' products, food, services, events or deliveries. To the extent permitted by law, Cooku will not be liable for indirect damages arising from the use of these pages.
Nothing in these terms limits the rights granted to you by consumer protection law. We recommend that you first submit any complaint to the restaurant; you can also write to us at hola@usecooku.com and we will help you contact it. If it is not resolved, you may go to the Autoridad de Protección al Consumidor y Defensa de la Competencia (ACODECO), Panama's consumer protection and competition authority.
11. Governing law
These terms are governed by the laws of the Republic of Panama. Disputes with Cooku will be submitted to the competent courts of Panama City, Republic of Panama, without prejudice to any right that consumer protection law grants you to go to the authorities or courts of your place of residence.
12. Changes
We may update these terms; the current version will always be on this page with its date. Changes do not affect orders, reservations or tickets already confirmed.
13. Language
This English version is provided for convenience. In case of any discrepancy, the Spanish version published on this site for your country prevails.
